Terms of Use

HEAL.ONLINE — TERMS OF USE

Effective Date: August 28, 2026

Operated by 4KIDS of South Florida, Inc.

Please read these Terms of Use (“Terms”) carefully before using Heal.online.

1. Acceptance of Terms

By accessing or using the website located at Heal.online (the “Site”), including any content, features, tools, or services made available through the Site (collectively, the “Services”), you (“you” or “User”) agree to be bound by these Terms and the policies expressly incorporated into them. If you do not agree, you must not access or use the Site or Services. Where the Site asks you to submit a Telehealth Request, create an account, purchase a resource, or otherwise take an action that requires affirmative acceptance, you will be asked to acknowledge these Terms before proceeding. If you use the Site for or on behalf of a minor, you agree to these Terms to the extent you have legal authority to do so; nothing in these Terms eliminates any right a minor may have under applicable law to consent to limited services without parental or guardian consent.

2. Description of the Site and Services

Heal.online is operated by 4KIDS of South Florida, Inc. (“4KIDS,” “Company,” “we,” “us,” or “our”). The Site provides Educational Content and information about a separate behavioral-health therapy program and may provide intake, scheduling, or referral functionality as described below:

  • Educational and informational content, including blog posts, articles, and related materials, regarding behavioral health, wellness, and related topics, provided solely for general educational and informational purposes (“Educational Content”); and
  • A means for individuals to submit a request to be considered for behavioral-health telehealth services (a “Telehealth Request”). If a request is accepted, Telehealth Services are provided by appropriately licensed mental health professionals, including licensed independent-contractor therapists (“Providers”), under a separate client agreement and informed consent. Individualized therapy is not delivered through the public-facing Educational Content, blog, comments, prayer-request forms, general contact forms, or other public features of the Site.

Submitting a Telehealth Request does not create a therapist-client, counselor-client, physician-patient, pastoral, fiduciary, or other professional relationship; does not guarantee that a Provider will accept the request; and does not guarantee any particular Provider, appointment time, course of treatment, clinical result, or outcome. A clinical relationship, if any, begins only as provided in the applicable intake documents, client agreement, informed consent, and applicable law.

3. Educational Content; No Professional Relationship; NO EMERGENCY SERVICES

The Educational Content is provided solely for general educational and informational purposes and reflects 4KIDS’ Christian perspective. It is not medical, psychological, psychiatric, marriage and family therapy, mental-health counseling, clinical social work, pastoral counseling, diagnosis, treatment, or other individualized professional advice, and it does not create a professional or fiduciary relationship between you and 4KIDS, any author, or any Provider. Content written by a licensed professional does not constitute the practice of that profession in every jurisdiction where the Content may be read. Always seek individualized advice from an appropriately qualified and licensed professional. The Site’s separate Editorial, Educational, and Legal Disclaimer, available at [link to Disclaimer], is incorporated into these Terms by reference.

EMERGENCY NOTICE

Heal.online is NOT designed or intended for use in medical, psychiatric, safety, abuse, or other emergencies and DOES NOT PROVIDE EMERGENCY OR CRISIS SERVICES. We do not continuously monitor Telehealth Requests, comments, forms, messages, prayer requests, email, or other Site communications for emergencies. If you or someone else is in immediate danger or experiencing a medical or psychiatric emergency, call 911 (or your local emergency number) immediately. In the United States, you may call or text 988 to reach the 988 Suicide & Crisis Lifeline. For domestic violence, you may contact the National Domestic Violence Hotline at 1-800-799-7233. To report suspected abuse, abandonment, or neglect of a child or vulnerable adult in Florida, contact the Florida Abuse Hotline at 1-800-96-ABUSE (1-800-962-2873). Do not use the Site or submit a Telehealth Request in place of seeking emergency or crisis care.

4. Eligibility; Minors and Parental/Guardian Consent

The Site’s general Educational Content may be viewed by adults and minors, but submission of personal information and requests for Telehealth Services are subject to age, consent, custody, privacy, and healthcare laws and to the requirements below.

  • Adult Users. If you are 18 years of age or older, you may use the Site and submit a Telehealth Request on your own behalf, subject to your legal capacity to consent to healthcare services and any other requirements of applicable law.
  • Minor Users. A child under 18 should not independently submit a Telehealth Request, create an account, or provide personal information through the Site; a parent or legal guardian should do so on the child’s behalf. For users ages 17 and under, a parent or legal guardian ordinarily must participate in intake and provide any consent required by applicable law. 4KIDS and Providers reserves the right and may verify age, identity, custody or guardianship, legal authority, and consent before providing Telehealth Services.
  • Parent/Guardian Users. If you submit a Telehealth Request or otherwise act for a minor, you represent that the information you provide is accurate and complete and that you have the legal authority required for the action you take. You agree to disclose any custody order, parenting plan, guardianship limitation, or other legal restriction that may affect consent, access to records, communications, or participation in services, if requested during intake.

5. Telehealth Services; Informed Consent; Licensure

  1. Telehealth Services, if provided, are delivered by Providers who are responsible for the clinical assessment, diagnosis, treatment recommendations, professional judgment, documentation, mandatory-reporting obligations, and standard of care applicable to the services they provide. Providers may include licensed independent contractors participating in the Heal.online therapy program. The public Site itself does not deliver individualized therapy, and use of Educational Content or submission of a Telehealth Request alone does not create a clinical relationship.
  2. Before Telehealth Services begin, you (or another person legally authorized to consent, when required) will be asked to review and accept a separate client agreement and telehealth informed consent addressing the nature of telehealth, reasonably foreseeable benefits and risks, privacy, communications, emergency planning, fees if applicable, and any jurisdiction-specific requirements. Telehealth Services are available only when the Provider is licensed or otherwise legally authorized to serve a patient in the jurisdiction where the patient is physically located. You must provide accurate location information during intake and, if requested, at each telehealth session. Availability may change if you travel or relocate.

6. Health Information and Privacy

The Privacy Policy at [link to Privacy Policy] describes information practices associated with the public Site and is incorporated into these Terms by reference. To the extent 4KIDS or a Provider creates, receives, maintains, or transmits protected health information in a HIPAA-covered capacity, the applicable Notice of Privacy Practices (“NPP”) at [link to Notice of Privacy Practices] separately describes HIPAA privacy practices and patient rights. The NPP is a legally required notice and is not incorporated as a contractual promise beyond applicable law. Clinical records and Telehealth Services also may be subject to additional federal or state confidentiality laws and to the separate client agreement and informed consent. By submitting a Telehealth Request, you acknowledge that you have been given an opportunity to review the applicable privacy notices; any acknowledgment of receipt does not constitute a waiver of privacy rights.

7. Registration and Accuracy of Information

To submit a Telehealth Request or access certain features, you may be required to provide information about yourself or a person for whom you are legally authorized to act, including contact and health-related information. You agree to provide accurate, current, and complete information and to update it as appropriate. If account credentials are issued, you are responsible for maintaining their confidentiality and for activity under your account, except to the extent caused by 4KIDS’ failure to use reasonable security measures. Do not use general email, public comments, or other non-designated public Site features to send emergency information or sensitive clinical details; use the secure channels identified during intake for clinical communications.

8. User Conduct; User Submissions and Interactive Features

  1. You agree not to:
  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Provide false, inaccurate, or misleading information;
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity;
  • Interfere with or disrupt the operation of the Site or any servers or networks connected to the Site;
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems;
  • Use any robot, bot, scraper, crawler, data-mining tool, automated agent, or similar means to access, copy, monitor, index, harvest, train an artificial-intelligence or machine-learning model on, or otherwise exploit the Site or Content without our prior written consent, except for standard search-engine indexing that complies with our technical instructions;
  • Upload or transmit viruses, malware, or other harmful code; or
  • Use the Site to harass, abuse, threaten, exploit, or harm another person; disclose another person’s confidential or health information without lawful authority; or submit content that infringes another person’s intellectual-property, privacy, publicity, or other rights.
  1. To the extent the Site enables comments, prayer requests, reviews, forums, forms, or other user submissions, you retain any ownership rights you have in your submission. You grant 4KIDS a non-exclusive, worldwide, royalty-free, perpetual license to host, reproduce, display, transmit, and otherwise use the submission only as reasonably necessary to operate, secure, moderate, and provide the applicable Site feature, unless a separate notice for that feature states otherwise. Do not post protected health information, confidential information, or information about another person in a public or community-facing area of the Site, which is prohibited.

4KIDS reserves the right  and may remove or restrict submissions that violate these Terms or create safety, privacy, intellectual-property, security, or legal concerns. Unless a specific feature expressly states otherwise, public or community-facing submissions are not confidential, are not clinical communications, and are not monitored as a crisis service.

9. Intellectual Property

The Site and its Educational Content, text, graphics, logos, images, videos, audio, design, selection, arrangement, and other materials (excluding content you lawfully submit and third-party materials identified as such) are owned by or licensed to 4KIDS and are protected by copyright, trademark, and other intellectual-property laws. Subject to these Terms, 4KIDS grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and to print or download a reasonable number of pages solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, sell, license, or commercially exploit Site Content without prior written consent, except as permitted by applicable law. All rights not expressly granted are reserved. Third-party names, marks, publications, Scripture translations, and other materials remain the property of their respective owners and are used subject to applicable licenses and law.

10. Third-Party Links and Services; Purchases and Additional Terms

  1. The Site may contain links or references to third-party websites, crisis resources, research, books, professionals, tools, products, or services that are not owned or controlled by 4KIDS. A link or reference is provided for convenience or educational context and does not, by itself, constitute endorsement, credential verification, or a warranty by 4KIDS. We are not responsible for third-party content, availability, security, privacy practices, or terms. Your use of a third-party website or service is at your own risk and is subject to that third party’s terms and policies.
  2. If the Site offers devotionals, journals, ebooks, courses, videos, donations, or other resources or transactions, additional checkout, refund, donation, subscription, or program terms may apply. Those additional terms will be presented at the point of transaction and, if they conflict with these Terms as to that transaction, the more specific terms will control. Purchasing or using an educational or devotional resource does not enroll you in Telehealth Services or create a professional relationship.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PUBLIC SITE AND EDUCATIONAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” 4KIDS DISCLAIMS WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND FITNESS OF THE EDUCATIONAL CONTENT FOR ANY INDIVIDUAL’S PARTICULAR CONDITION OR CIRCUMSTANCES. MENTAL-HEALTH SCIENCE, PROFESSIONAL STANDARDS, AND OTHER INFORMATION CHANGE OVER TIME, AND 4KIDS DOES NOT UNDERTAKE TO UPDATE EVERY ARTICLE. THIS SECTION DOES NOT MODIFY ANY WARRANTY, PROFESSIONAL DUTY, OR STANDARD OF CARE THAT CANNOT LAWFULLY BE DISCLAIMED OR THAT APPLIES UNDER A SEPARATE CLIENT AGREEMENT TO TELEHEALTH SERVICES.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 4KIDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AUTHORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE PUBLIC SITE OR EDUCATIONAL CONTENT, EVEN IF FORESEEABLE. FOR CLAIMS ARISING SOLELY FROM NON-CLINICAL USE OF THE SITE OR EDUCATIONAL CONTENT, THE AGGREGATE LIABILITY OF 4KIDS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO 4KIDS THROUGH THE SITE FOR THE APPLICABLE NON-CLINICAL PRODUCT OR SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY TO THE EXTENT CAUSED BY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, AND THEY DO NOT LIMIT A LICENSED PROVIDER’S PROFESSIONAL LIABILITY OR ANY DUTY OR REMEDY GOVERNED BY THE SEPARATE CLIENT AGREEMENT OR APPLICABLE PROFESSIONAL-LIABILITY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless 4KIDS and its officers, directors, employees, volunteers, agents, affiliates, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable attorneys’ fees to the extent arising from your unlawful misuse of the Site, your material violation of these Terms, content you submit that violates another person’s rights, or your fraud or intentional misconduct. This indemnity does not apply merely because you submit a Telehealth Request, seek or receive Telehealth Services, or assert a good-faith healthcare, privacy, consumer-protection, or other statutory right.

14. Termination

We may suspend or terminate access to the public Site or particular Site features if reasonably necessary for security, maintenance, legal compliance, or a violation of these Terms. Termination of access to the public Site does not, by itself, terminate an existing therapeutic relationship or authorize abandonment of a patient; any suspension, transfer, or termination of Telehealth Services is governed by the separate client agreement, applicable professional standards, and law. You may stop using the public Site at any time. Provisions that by their nature should survive will survive, including intellectual-property, warranty, liability, indemnity, dispute, and severability provisions.

15. Changes to These Terms

We may update these Terms from time to time. We will post revised Terms with an updated effective date and, when reasonably appropriate for a material change affecting registered users or intake, provide additional notice. Changes apply prospectively when they take effect. A change to the governing-law, forum, liability, or dispute provisions will not apply to a dispute for which either party had actual written notice before the change became effective. Continued use of the Site after revised Terms take effect constitutes acceptance to the extent permitted by applicable law.

16. Governing Law; Dispute Resolution; Limitations Due to User Location

  1. These Terms and disputes arising from the public Site or Educational Content will be governed by Florida law, without regard to conflict-of-laws principles. Except where prohibited by law or where a separate client agreement validly provides otherwise for a dispute arising from Telehealth Services, any legal action arising from these Terms or the public Site must be brought exclusively in the state courts located in Broward County, Florida, or the United States District Court having jurisdiction over Broward County, and each party consents to personal jurisdiction and venue there. This section does not alter any non-waivable right, healthcare-specific venue rule, or dispute provision contained in an applicable client agreement.
  2. Educational Content may be accessible from locations outside Florida or outside the United States, but 4KIDS makes no representation that all Site Content is appropriate or lawful in every jurisdiction. Telehealth Services are offered only where the applicable Provider is legally authorized to serve a person physically located in that jurisdiction. Users who access the Site from elsewhere do so on their own initiative and are responsible for compliance with local law.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and the Editorial, Educational, and Legal Disclaimer expressly incorporated into them, constitute the agreement governing use of the public Site. The NPP, any telehealth informed consent, and any client or services agreement are separate documents that govern their respective subjects and are not superseded by these Terms. If a conflict exists regarding Telehealth Services, the applicable client agreement and informed consent control to the extent permitted by law.

19. Contact Us

If you have questions about these Terms, please contact us at the address below. Do not use the general contact information below for emergencies or time-sensitive clinical communications; use 911/988 or the secure clinical communication method identified during intake, as appropriate:
